SurgMD is a professional mobile application that enables registered medical practitioners to log surgical cases, track clinical fees, manage multi-hospital revenue, and store clinical documentation including photographs and videos. SurgMD is developed and operated by Dr. Choundappan Madhavan, trading as Chounda, and is available on iOS and Android.
By creating an account, downloading the app, or otherwise accessing SurgMD, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must not use SurgMD.
These Terms constitute a legally binding agreement between you and Dr. Choundappan Madhavan (the "Service Provider").
SurgMD is not available for use in the United States of America or the European Economic Area (EEA). By creating an account, you represent and warrant that you are not located in, and are not accessing SurgMD from, any of these restricted regions.
The Service Provider makes no representation that SurgMD is appropriate or available for use in all jurisdictions. You are responsible for compliance with local laws wherever you access the service.
SurgMD is intended exclusively for use by qualified, registered medical professionals — including surgeons, physicians, anaesthetists, and other procedure-based practitioners — who are aged 18 years or older.
By using SurgMD, you represent that:

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:
The Service Provider is not liable for any loss or damage arising from unauthorised account access caused by your failure to safeguard your credentials.
You agree to use SurgMD only for its intended professional purpose. You must not:
Violation of these rules may result in immediate suspension or termination of your account.
SurgMD offers the following subscription tiers: Free, Pro, and Ultimate. Current pricing is listed at chounda.com/surgmd/plan-details.
Subscriptions are available exclusively through the iOS App Store and Google Play Store. Purchases are billed and managed by Apple or Google respectively, through RevenueCat as our subscription management provider. Your subscription, billing cycle, and renewal are governed by the terms of the relevant app store. To cancel, you must do so through your Apple ID or Google Play account settings.
All subscription prices are displayed inclusive of applicable taxes. The Service Provider reserves the right to change pricing with reasonable advance notice to active subscribers.
Refunds are governed by Apple's App Store and Google Play's refund policies respectively. The Service Provider has no control over refund decisions made by Apple or Google. To request a refund, you must do so directly through your Apple ID or Google Play account.
All rights, title, and interest in and to SurgMD — including the application code, design, branding, trademarks ("SurgMD", "Chounda"), and all related materials — are and remain the exclusive property of Dr. Choundappan Madhavan.
These Terms do not grant you any ownership rights in SurgMD. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the application solely for your own professional purposes in accordance with these Terms.
You must not reproduce, redistribute, sell, or create derivative works from any part of SurgMD without prior written permission.
You retain full ownership of all case log data, clinical notes, and media ("Your Content") that you upload to SurgMD. By uploading content, you grant the Service Provider a limited, non-exclusive licence to store, process, and display Your Content solely for the purpose of providing the SurgMD service to you.
You are solely responsible for ensuring that Your Content — particularly any patient-identifiable information or clinical media — complies with applicable law, including patient consent requirements. The Service Provider does not review the content you upload and takes no responsibility for it.
Upon account deletion, Your Content will be permanently purged in accordance with our Privacy Policy.
All clinical decisions — including diagnoses, treatment choices, surgical approaches, and patient management — are the sole responsibility of the treating medical professional. The Service Provider expressly disclaims any liability arising from clinical decisions made by users of SurgMD.
SurgMD should not be used as the sole repository of medico-legal records. You are responsible for maintaining appropriate clinical records as required by the laws and professional standards of your jurisdiction.
SurgMD is provided "as is" and "as available" without warranties of any kind. The app is a professional logging aid and is not intended to serve as a primary storage or backup solution for patient media (photos/videos) or official medical records.
Client-Side Encryption: SurgMD encrypts your case data and clinical media on your device using AES-256 encryption before it is transmitted to our servers. This means your data is unreadable to the Service Provider and any third-party processor. Upon enabling encryption, you will be issued a Recovery Code — the sole means of decrypting your data. The Service Provider does not store or have access to Recovery Codes. You are solely responsible for storing your Recovery Code securely. Loss of your Recovery Code will result in permanent, irrecoverable loss of all encrypted data, and the Service Provider bears no liability for such loss.
Automated Encrypted Backups: SurgMD maintains automated encrypted backups of your case metadata (via Supabase) and clinical media (via AWS). These backups are encrypted with your client-side key. In the event of a ransomware attack or catastrophic failure, data restoration from backup is only possible if you retain your Recovery Code.
User Responsibility for Data Export: You are strongly advised to export your data regularly using the "Export Data" function within the app. Exported data is provided in decrypted, portable form — giving you a human-readable copy of your records that is entirely independent of the Application's encryption infrastructure. You should store these exports on a secure physical drive or hospital-approved server. Regular exports are the most reliable safeguard against data loss, as they place decrypted data directly in your custody.
User Responsibility for Redundancy: You are solely responsible for maintaining secondary, independent copies of all patient media on a secure physical drive or hospital-approved server. You must also periodically use the "Export Data" function within the app to create external backups of your text-based surgical logs.
To the maximum extent permitted by applicable law, the Service Provider shall not be liable for:
Where liability cannot be excluded by law, the Service Provider's total aggregate liability shall not exceed the amount paid by you for SurgMD in the preceding 18 months (for annual subscribers) or the preceding 3 months (for monthly subscribers), calculated from the date of the event giving rise to the claim.
You agree to indemnify, defend, and hold harmless Dr. Choundappan Madhavan and any associated personnel from and against any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to: (a) your use of SurgMD; (b) your breach of these Terms; (c) your violation of any applicable law or third-party right; or (d) any patient data or clinical media you upload to the service.
You may terminate your account at any time by deleting it through Settings → Delete Account in the app, or via surgmd.chounda.com/delete-account.
The Service Provider may suspend or permanently terminate your access to SurgMD, with or without notice, if:
Upon termination, your right to access SurgMD ceases immediately. Data deletion following account termination is handled as described in our Privacy Policy.
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or the use of SurgMD shall be subject to the exclusive jurisdiction of the courts of Salem, Tamil Nadu, India.
Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute by contacting us at [email protected] and allowing 30 days for a good-faith resolution.
We may update these Terms from time to time to reflect changes in our service, applicable law, or business practices. When material changes are made, we will update the Effective Date at the top of this page and, where appropriate, notify active users by email or in-app notice.
Your continued use of SurgMD after any changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using SurgMD and delete your account.
