These Terms of Service ("Terms") govern your use of NexOP, provided by Chounda Tech (OPC) Private Limited, trading as Chounda ("Chounda Tech", "we", "us"), located at Vanitha Hospital, 3/231, Sankagiri Main Road, Kondalampatty, Salem – 636010, Tamil Nadu, India. By creating an account, downloading the App, or otherwise accessing NexOP, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use NexOP.
NexOP is an outpatient visit registration and billing application for clinics, developed and operated by Chounda Tech (OPC) Private Limited, available on iOS and Android. NexOP is a billing and operations tool — it is not intended for clinical documentation, diagnoses, or prescriptions.
NexOP is intended for use by clinics, clinic staff, and registered medical professionals aged 18 years or older who have the legal authority to enter into these Terms. NexOP is not available in the United States or the European Economic Area, and users in those regions may not create accounts; this Agreement makes no claims of compliance with HIPAA, GDPR, or other US/EU frameworks. We reserve the right to suspend or terminate accounts that do not meet these eligibility requirements.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your clinic account. As the account holder, you are responsible for your own patients' data and for meeting any healthcare or data-protection compliance obligations applicable in your jurisdiction. Accounts are non-transferable and personal to the registered clinic. Notify us immediately at [email protected] if you suspect unauthorised access.
You agree to use NexOP only for its intended purpose of lawful outpatient visit registration and billing. You must not: enter false or fabricated billing or patient information; upload patient data without appropriate consent under applicable law; attempt to reverse-engineer, decompile, or extract the App's source code; circumvent or interfere with its security features; or use the App in any manner that could damage or impair the service for other users.
NexOP offers a Free plan and a paid Pro subscription (monthly or yearly). Subscriptions are billed and managed exclusively through the Apple App Store or Google Play Store, using RevenueCat as our subscription management provider. We do not collect or store your card details directly. Your subscription, billing cycle, and renewal are governed by the terms of the relevant app store; to cancel, do so through your Apple ID or Google Play account settings.
Refunds are governed by Apple's App Store and Google Play's refund policies respectively. We have no control over refund decisions made by Apple or Google — to request a refund, do so directly through your Apple ID or Google Play account. Downgrading your subscription does not entitle you to a pro-rata refund for the unused portion of your current billing cycle.
All rights, title, and interest in and to NexOP — including its code, design, branding, and trademarks — are and remain the exclusive property of Chounda Tech (OPC) Private Limited. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App solely for your clinic's operations in accordance with these Terms. You must not reproduce, redistribute, sell, or create derivative works from any part of NexOP without prior written permission.
You retain full ownership of all visit, billing, and patient records ("Your Content") that you upload to NexOP. By uploading content, you grant us a limited, non-exclusive licence to store, process, and display Your Content solely to provide the NexOP service to you. You are solely responsible for ensuring Your Content complies with applicable law, including patient consent requirements. Upon account deletion, Your Content is purged in accordance with our Privacy Policy.
NexOP is provided "as is" and "as available" without warranties of any kind. It is a registration and billing aid and is not intended as a primary or sole system of record for clinical or medico-legal purposes, nor does it guarantee compliance with any healthcare regulation. We do not warrant that the App will be error-free or uninterrupted. You are strongly advised to export your data regularly using the "Export Data" function and store those exports securely; the Service Provider is not liable for loss of data arising from technical failure, device loss, accidental deletion, or your failure to perform recommended manual exports.
To the maximum extent permitted by law, Chounda Tech shall not be liable for indirect, incidental, special, or consequential damages, or for loss of data or revenue arising from your use of NexOP, including any interruption or unavailability of the service. Where liability cannot be excluded by law, our total aggregate liability shall not exceed the amount you paid for NexOP in the preceding 12 months, calculated from the date of the event giving rise to the claim.
You agree to indemnify, defend, and hold harmless Chounda Tech (OPC) Private Limited from any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to your use of NexOP, your breach of these Terms, your violation of any applicable law or third-party right, or any patient or billing data you upload to the service.
You may cancel your subscription at any time through the App Store or Play Store, and may delete your account at any time. We may suspend or terminate accounts that violate these Terms, are used by an ineligible party, or where required by law. Your clinic's data is retained and deleted per our Privacy Policy following termination.
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Salem, Tamil Nadu, India. Before initiating formal legal proceedings, you agree to first attempt to resolve any dispute by contacting us at [email protected] and allowing 30 days for a good-faith resolution.
We may update these Terms from time to time. When material changes are made, we will update the effective date above and, where appropriate, notify active users by email or in-app notice. Continued use of NexOP after changes take effect constitutes acceptance of the revised Terms.
